Standard Terms and Conditions


Freight Policy 


At Preferred Medical we pride ourselves on service. Most orders placed before 2 pm will be shipped the same business day, with the following guidelines:

 Non-Bulk orders:

  • Stocked non-bulk orders of $350+ qualify for free freight
  • Stocked non-bulk orders less than $350 will incur actual freight charges

Bulk orders:

  • Stocked bulk orders of $1,500+ qualify for free freight
  • Stocked bulk orders less than $1,500 will incur actual freight charges
  • $1,500 bulk minimum can be combination of bulk and non-bulk items
  • Bulk shipments require special carrier scheduling, and will be shipped on the first available trailer

Bulk items include but are not limited to: enteral products, cleaning solutions, gloves, formula, liquids, DME products and incontinence items.

Special ordered items that require shipping will be billed on the invoice at the freight carriers cost.

Distribution fees, order fees and per case fees may also apply.


Return Policy/Restocking Fees


At Preferred Medical we strive to fulfill all your medical supply needs in 100% of the instances. Where the product we supply to you does not meet your needs, we will gladly allow you to return them to Preferred Medical, with the following guidelines:

  • Buyer may return any regularly stocked items to Seller within 30 days of purchase for full refund/credit for product as long as the product is in its original unopened packaging and in re-saleable condition. 
  • Buyer must contact Seller to request a Return Merchandise Authorization ("RMA") for all product returns. Seller will not accept any returns without an approved current RMA.
  • Return requests within 30 days of purchase will not be charged a restocking fee.
  • Return requests more than 30 days beyond the original purchase date will be charged a restocking fee of 25%. Return request beyond 90 days from purchase date will be subject to special approval and restocking fee.
  • Special ordered and Non-stock items are not returnable.  


Pump Rental & Repair Policy


Rentals

If a rented pump is lost or unavailable for return for any other reason, the customer is responsible for the full purchase price of that particular pump. The associated lost/replacement charge is based on the make, model and serial number from the originally rented pump.

Rental Equipment Billing: Customer shall receive an invoice for Rental Equipment from Preferred Medical on a monthly basis. Preferred Medical periodic invoices will list each item of rental equipment in the possession of customer during the previous rental period. It is the responsibility of customer to review each periodic rental invoice and notify Preferred Medical of any rental equipment which is not in the possession of customer. Such discrepancies must be reported to Preferred Medical in writing within seven (7) calendar days of customers receipt of the invoice or customer will be deemed to have acknowledged possession of the rental equipment.

Acceptance of Rental Equipment: With each rental order, Customer will receive a packing slip detailing all Rental Equipment and accessories shipped. All Rental Equipment and accessories shall be deemed by customer as conforming and free from defect unless customer notifies Preferred Medical in writing, within seven (7) days of receipt by customer that the Rental Equipment and accessories delivered do not conform to customer’s order and are defective.

Title: All Rental Equipment and accessories shall remain the sole and exclusive property of Preferred Medical. Customer shall have no right, title or interest to or in the Rental Equipment and accessories, except the right to make use thereof and the right to maintain possession thereof in accordance with the terms of this agreement. Preferred Medical hereby represents and warrants to customer that Preferred Medical has the full legal right and authority to rent the rental equipment to customer as set forth herein. Customer agrees to clearly identify all equipment rented hereunder as Preferred Medical property. In accordance with 9-509(a)(1) of the Uniform Commercial Code (“UCC”) customer hereby authorizes the filing by Preferred Medical at any time from and after the date of this agreement (including without limitation prior to delivery of the rental equipment) of a security agreement in accordance with 9-502(d) of the Uniform Commercial Code including financing statements and to the extent necessary or appropriate, amendments thereto, in all appropriate jurisdictions which reflect the ownership of title and any and all other valid security interests taken in favor of Preferred Medical with respect to any and all equipment rented hereunder.

Assign and Modify: Customer may not assign or transfer any rights duties or obligations hereunder without the prior written consent of Preferred Medical. This agreement, including all packing slips enclosed with the rental equipment and attachments hereto, constitute the entire agreement between customer and Preferred Medical and shall not be amended without written consent of both parties. 

Limit of Liability: In no event will Preferred Medical be liable for (l) any special consequential or incidental damage or (ii) any cost or procurement of substitute products or services or (iii) any damages whatsoever resulting from loss of use or profits that customer may suffer directly or indirectly, regardless of the form of the action whether in contract, tort (including negligence) strict product liability or otherwise even if Title: All Rental Equipment and accessories shall remain the sole and exclusive property of Preferred Medical . Customer shall have no right, title or interest to or in the Rental Equipment and accessories, except the right to make use thereof and the right to maintain possession thereof in accordance with the terms of this agreement. Preferred Medical hereby represents and warrants to customer that Preferred Medical has the full legal right and authority to rent the rental equipment to customer as set forth herein. Indemnification: Customer agrees to indemnify, hold harmless and defend Preferred Medical against all losses, claims, suits, damages actions, causes of action, proceedings, demands, assessments, settlements, judgements, costs, expenses and any other liabilities of any kind or nature including reasonable attorney’s fees imposed or arising out of or relating to customer’s negligence or willful act or omission. Preferred Medical shall not be required to take any action or make any claim against a third person as a precondition to seeking indemnification hereunder. Preferred Medical shall timely notify customer of any intended claim for indemnification.

Repairs

In the event that Preferred Medical determines that malfunctioning of Rental Equipment is a result of accident, alteration, misuse, damage repair by other than a Preferred Medical authorized representative or in the event that at the time of failure, such Rental Equipment was not being operated in the manner prescribed Preferred Medical in the original manufacturers operating manual, Preferred Medical will charge to customer and customer agrees to Preferred Medical for either the cost of repair to bring the rental equipment to original manufacturer specifications or the replacement cost of the rental equipment. Under no circumstances will previously remitted rental fees be applied to cover the cost of repair or replacement.
